New System for H-1B Labor Condition Applications

As part of processing H-1B petitions, FSIS files Labor Condition Applications (LCAs) electronically with the U.S. Department of Labor (DOL). Beginning April 15, 2009, DOL plans to implement a new system for LCAs. There will be a month's transition whereby we can use the old online system and the new iCERT system. From July 1, 2009, we will be required to file LCAs using iCERT.

This message is to inform hiring units that the new iCERT system is expected to increase processing time for LCAs up to 7 business days. There will be an official review and DOL certification of each LCA submitted in the new system. FSIS will no longer be able to accommodate last minute requests for H-1B petition processing since the required LCA will no longer be immediately certified after electronic submission. Therefore, please plan accordingly for time-sensitive H-1B petitions.
