Fees

E-3 employees are prohibited from paying E-3 petition filing fees. The E-3 petition fee must be paid by the sponsoring UH college/school/unit or department. However, an E-3 employee may be responsible for paying the Form I-539 filing fee for E-3D dependents.

Departments should request filing fee checks through the usual UH procedures. At the time of making the request, be sure to indicate that the checks should be returned to the department rather than mailed directly to USCIS. Each applicable fee must be stapled to its accompanying form and be paid by separate checks/money orders from a financial institution in the U.S. All fees should be payable in U.S. dollars to the “U.S. Department of Homeland Security.”

*An E-3 petition does not need to be filed for an employee who will begin E-3 employment by entering the U.S. from abroad. In such a case, no E-3 petition fees apply, but if the worker may need to pay E-3 visa fees if an E-3 entry visa from a U.S. embassy/consulate is required.

A hiring unit must provide a mailing label reflecting the appropriate address to FSIS. FSIS will mail the E-3 petition with the appropriate filing fee(s) to the USCIS Vermont Service Center at one of the addresses below.

Fees

*Generally, this fee is viewed as a business expense of the UH department employing the H-1B worker. However, if the employee alone wishes to request premium processing service for purely personal, non work-related reasons (e.g. taking a personal trip, applying for a driver’s license for personal use, etc.), the fee may be paid by the worker. In such a case, the worker should email FSIS, the department chair, and the HR specialist a statement explaining their personal reasons for requesting premium processing service; FSIS will prepare Form I-907 if the request is deemed appropriate.
