I. Purpose

To provide guidelines for the scope and content of international agreements at the system level, and to set procedures for the processing of international agreements.

II. Definitions

No policy specific or unique definitions apply.

III. Executive Policy

A. This policy guides the implementation of RP 5.204 of the Board of Regents Policies governing affiliations.  Affiliations with foreign institutions, in contradistinction to contracts, are referred to herein as international agreements which:

        1. may be entered into by the University;

        2. which strengthen the mission of the University, and provide international opportunities for students, faculty, scholars, and administrative staff;

        3. must be compatible with University objectives;

        4. must enhance the teaching, research, or service mission of the University.

B. Scope and Content.  International agreements are at  the system or campus level.

    1. At the system level, a Memorandum of Understanding (MOU) signed by the UH president and international counterpart is an

    2. agreement that establishes a broad context and intent for inter-institutional cooperation that includes all campuses.

    3. At the UHCC system and at campus levels, a Memorandum of Understanding (MOU) signed by the CC vice president, chancellor or designee and international counterpart is an agreement that establishes a broad context and intent for partnership with the UHCC system, a campus, college, or department.  Such Memorandum of Agreement (MOA) signed specifies collaborations, exchanges, research, or other forms of partnership with the UHCC system, campus, college, or department.  MOAs must contain clear descriptions of the activities which are to take place accompanied by implementation guidelines.

    4. Implementation of an aspect of a system level MOU through a campus level collaboration, exchange, research, partnership, or other activity will be the subject of a separate campus (or college or department) level MOA.

    5. International agreements must  exhibit::

        a. Consistency with University system and campus mission statements, long-term goals, objectives and current initiatives;

        b. Clarity of stated
purpose, goals, and benefits to UH;

        c. Ability to satisfy any financial or other institutional obligations incurred in the MOA;

        d. Conformity with relevant federal or other government regulations;

        e. That its provisions do not impinge upon the autonomy of the University;

        f. The possibility for revision of the agreement and an expiration date.

    5.    International agreements must be consistent with all other existing Board and University policies and contractual requirements.

        a. Long-term resource commitments to implement agreements are subject to established Board and University budgeting procedures and policies.

        b. Program plans included in agreements are subject to established Board and University policies relating to the approval of new programs.

C. Administrative Requirements

    1. A draft text of each proposed system level international agreement must be reviewed by the Office of International and Strategic Initiatives in the Office of the Executive Vice President for Academic Affairs which functions as a systemwide support and facilitating office. 

    2. A Systemwide International Committee, appointed by the President, will review the draft agreement for appropriateness.  Proposals for agreements with major financial obligations or with significant impact on University programs will be submitted to the Board of Regents for approval.  If appropriate, proposals will also be reviewed by the Office of the Vice President for Research and Innovation and the Office of the Vice President for Budget and Finance/Chief Financial Officer.

    3. Following review, the proposed system level agreement will be submitted to the Office of the President.  The agreement will be valid only when signed by the President or his designee.  An original copy of the fully executed agreement must be filed with the Office of the President.

    4. The UH System Office of Strategic and International Initiatives will prepare an annual report on system level MOUs which will be transmitted by the President to the Board of Regents.

IV. Delegation of Authority

The Chancellor or Vice President of each unit (University of Hawai‘i at Mānoa; University of Hawai‘i at Hilo; University of Hawai‘i West O‘ahu; and the Community College System) is delegated authority to enter into campus-level agreements or to further delegate as appropriate, and to establish administrative procedures and guidelines.  These agreements shall comply with the requirements of this Executive Policy.
