COUNTY INDEMNIFICATION

If you are planning to utilize a County facility (City and County of Honolulu, Hawaii County, Kauai County, Maui County, or Kalawao County) and are required to obtain a permit, you will need to contact the Office of Risk Management to request approval to indemnify a county agency. Requests should be submitted no later than 8 weeks prior to the date of your activity.

County agency permits contain a provision that requires the holder of the permit to indemnify the County. The University of Hawaii has no authority to enter into an agreement to indemnify another party unless authorized by the legislature. Pursuant to Hawaii Revised Statutes §46-71.5, the University of Hawaii may agree to indemnify, defend, and hold harmless a county agency if certain preconditions are satisfied. Upon request, the Office of Risk Management will assist you with obtaining the necessary approvals from internal (UH) and external administrators to meet the requirements of this statute.
