The University of Hawaii ("UH") has an Academic Computing Offer License Agreement ("Agreement") with SAS Institute Inc. ("Institute") to use the SAS System Software ("Software") for Windows and Macintosh operating systems. The rights of the UH are those of a licensed user only. The Institute may discontinue the license if the UH fails to comply with the Agreement. The UH is bound by the following terms and conditions.

Use of the Software is restricted to UH employees and registered students. UH employees and students may not use the Software for their own commercial purposes. The Software may not be used outside the USA. Use of the Software must be on UH owned or leased hardware and located on UH premises. Home use by employees and registered students is allowed if the employee/student signs a home-use agreement form.

The Software is copyrighted and contains trade secrets of the Institute. Title to the Software remains with the Institute at all times. In order to protect the Institute's trade secrets in the Software, users may not access the Software source code by reverse engineering, decompiling or any other means.

The right to possess and use a copy of the Software must be obtained from UH Information Technology Services (ITS) for each machine (personal computer or single user workstation) from which the Software will be used or accessed. Where networks of intelligent and nonintelligent terminals are used, each such terminal shall be counted as a separate machine. The physical location of each machine used to access the Software shall be provided to ITS with this Agreement.

ITS has designated a SAS Software Installation Representative and Consultant to act as liaison between you and the Institute to obtain limited consultation on specific problems that arise in the installation and use of the Software. The Institute neither guarantees consultation results nor warrants that all errors or bugs will be corrected. Call ITS's SAS Representative if you have problems.

The renewal fee is $60 per machine per year and is subject to change.

Include the initial fee with the signed agreement form. Payment can be made with a UH requisition, RCUH PO or a check.

I agree to be bound by the terms and conditions above. I further agree to pay ITS an initial fee and a yearly renewal fee per machine accessing the Software.
